Welcome to ToolAI Kit. These Terms of Service ("Terms") govern your access to and use of the ToolAI Kit website, applications, and related services (collectively, the "Service"). ToolAI Kit ("we" or "us") operates the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, making a purchase, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and ourPrivacy PolicyWe reserve the right to modify these Terms at any time. Changes take effect upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Service Description

ToolAI Kit provides AI-powered digital tools, including but not limited to:

  • AI Passport Photo Generator (Passport, Visa, ID Photos)
  • AI Smart Background Removal
  • PDF Tools
  • More AI tools coming soon

Standard resolution processing is free. HD output and advanced features require a paid subscription or one-time purchase.

3. User Accounts & Registration

To use premium features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

  • Provide accurate, current, and complete registration information
  • Keep your information up to date
  • Notify us immediately of any unauthorized account use

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Billing, Subscriptions & Payments

All payments on ToolAI Kit are processed through our authorized official merchantPaddleBy making a purchase, you agree to Paddle's terms and authorize Paddle to process your payment. Key billing terms:

  • Unless otherwise stated, all prices are in US Dollars (USD)
  • Subscription plans auto-renew at the end of each billing cycle unless cancelled before the renewal date
  • Lifetime plans grant you perpetual access to the service version at the time of purchase
  • Applicable taxes are calculated and collected by Paddle based on your location
  • Cryptocurrency payments are processed via CCPayment as an alternative payment method

We do not store your full payment card information on our servers. All payment data is securely processed by payment service providers.

5. Refund Policy

Due to AI computing resources and cloud infrastructure costs incurred instantly upon processing, all purchases are generally non-refundable. For the full cancellation process and exceptions, please refer to ourRefund Policy, which is incorporated by reference into these Terms.

6. Intellectual Property

Our Intellectual Property:The service, including its underlying AI models, algorithms, software code, website design, logos, and trademarks, is the proprietary intellectual property of ToolAI Kit. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the service without our express written permission.

Your Content:You retain full rights to the photos and images you upload and generate through the service. By uploading content, you grant us a limited, non-exclusive license solely to the extent necessary to provide the service (e.g., processing your images through our AI pipeline).

7. Prohibited Conduct

You agree not to engage in the following:

  • Use the service to generate illegal, fraudulent, or harmful content
  • Upload content that infringes others' intellectual property or privacy rights
  • Attempt to bypass, disable, or interfere with the security features of the service
  • Use unauthorized automated tools (bots, scrapers) to access the service
  • Resell, sublicense, or redistribute the service or its output as a standalone product
  • Use the service to create fake identity documents or commit identity fraud
  • Upload another person's portrait or a photo that is not your own, or use the service for face swap, deepfake, voice impersonation, or any other synthesis or fabrication involving a third party's identity or portrait

8. Limitation of Liability & Disclaimer

The service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, TOOLAI KIT disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, TOOLAI KIT shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles. Any dispute arising from these Terms or the service shall first be resolved through informal negotiation. If unresolved within 30 days, either party may submit the dispute to binding arbitration under the Singapore International Arbitration Centre (SIAC) rules.
